I.Ordering

When ordering please provide EU VAT number, Purchase Order number, delivery and invoice address. Purchase orders shall be addressed to:

II.Terms of price and payments

1.Price
Prices are without VAT and any local taxes.

2.Payment
The customer shall pay or all products and services purchased from Frontgrade Gaisler AB within 30 days from date of invoice. In the event of the Customer’s failure to pay within said 30 day period, Frontgrade Gaisler AB reserves the right to charge the Customer interest at the rate of 1.5% per month from the due date until paid. Frontgrade Gaisler AB may, for any reason and at any time, demand full or partial up-front payment for any order whenever Frontgrade Gaisler AB finds this appropriate. Frontgrade Gaisler AB may also specify in each quotation/order confirmation any other conditions related to the actual sale. The customer shall pay all taxes and duties associated with the purchase, other than taxes based on Frontgrade Gaisler’s income.

III.Delivery

Normal delivery time is one week unless otherwise is stated. Shipping is made with express mail (a surcharge of 70€) or upon request with customer specified shipping company / shipping account.

IV.Limited Warranty

FRONTGRADE GAISLER AB REPRESENTS AND WARRANTS THAT THE PRODUCTS CONFORM TO THE SPECIFICATIONS FOR A PERIOD OF (12) MONTHS, EXPECT TO THE EXTENT THAT IT IS MODIFIED BY PURCHASER, AND EXCEPT AS PROVIDED HEREIN; THERE ARE NO OTHER REPRESENTATIONS OR WARRANTIES PROVIDED, AND FRONTGRADE GAISLER AB HERBY EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

V.Limitation of Liability

IN NO EVENT SHALL FRONTGRADE GAISLER AB BE LIABLE UNDER ANY LEGAL THEORY, WHETHER IN TORT, CONTRACT OR OTHERWISE

(a) FOR ANY LOST PROFITS, LOST REVENUE OR LOST BUSINESS,

(b) FOR ANY LOSS OF OR DAMAGES TO OTHER SOFTWARE OR DATA, OR

(c) FOR ANY INCIDENTAL, INDIRECT, CONSEQUENTIAL OR SPECIAL DAMAGES RELATING TO THIS AGREEMENT OR THE SUBJECT MATTER HEREOF, INCLUDING BUT NOT LIMITED TO THE DELIVERY, USE, SUPPORT, OPERATION OR FAILURE OF THE PRODUCT, EVEN IF FRONTGRADE GAISLER AB HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LIABILITY.
